MINUTES of the Planning and Environment Committee meeting held on Monday 7th November, 2022 at 7.45 pm at the Day Centre Commercial Road

 

PRESENT:                 Cllr C Williams, Cllr A Mackie, Cllr D Sargison, Cllr M Ridger, Cllr T Bisdee.

PE42   APPROVAL OF MINUTES OF PREVIOUS MEETING

The minutes of the meeting held on 17th October, 2022 were APPROVED.

 

Item PE45 was discussed first for the convenience of residents in attendance.This change was proposed by Cllr C Williams and seconded by Cllr D Sargison. Unanimous

 

PE43   PLANNING APPLICATIONS FOR CONSIDERATION

·         Loss of parking

·         Construction will be over the main sewer

·         There is no apparent provision for dealing with the additional foul and surface water at a point where the drainage systems are ‘combined’ Unanimous.

b)22/02911/FULL Worcester House Lucks Lane Paddock Wood Tonbridge Kent TN12 6PA. Removal of condition 1 of Planning Permission SW/6/49/77 (Occupation of dwelling) Cllr C Williams proposed and Cllr T Bisdee seconded that the Council have no objection to this application, Unanimous
c)22/02820/FULL 13 Le Temple Road Paddock Wood Tonbridge Kent TN12 6HY. Building of new front porch approximately 2m square Cllr C Williams proposed and Cllr T Bisdee seconded that the Council have no objection to this application, Unanimous
d)22/02961/FULL 3 Pinewood Close Paddock Wood Tonbridge Kent TN12 6JN. Alteration to garage roof, Erection of extension to rear of garage Cllr M Ridger proposed and Cllr A Mackie seconded that the Council object to this application as the amateurish diagram containing no clear detail should not have been validated as an application and makes it impossible to comment upon the proposal. Unanimous
e)22/02845/FULL 2 Pearsons Green Cottages Pearsons Green Road Brenchley Tonbridge Kent TN12 7DE. Erection of temporary storage facility Cllr M Ridger proposed and Cllr C Williams seconded that the Council object to the application on the grounds that the application says there is no new access whilst the plans show there is one and also that there is no information regarding the hard standing and drainage that would have to be installed if the ‘tent’ is to be storage for vehicles. Unanimous.

 

f)22/03107/FULL Trenches Farm House Knowle Road Brenchley Tonbridge Kent TN12 7DJ. Conversion of existing barn to residential dwelling and hard and soft landscaping Cllr M Ridger proposed and Cllr A Mackie seconded that the Council object to this application until such time as an unredacted copy of the bat and ecological report is supplied. Unanimous.

 

 

PE44 DECISIONS BY TUNBRIDGE WELLS BOROUGH COUNCIL

The Council would point out that there is already a problem with parking congestion in the shared spaces at the front of the properties and this may be exacerbated if the additional bedroom results in an increased number of vehicles
b)22/02381/FULL Two storey side extension to replace existing garage | 20 Le Temple Road Paddock Wood Tonbridge Kent TN12 6HY Permitted Object to the application on the grounds of loss of parking.

These were noted.

 

PE45 TO DISCUSS DECISION ON PLANNING APPLICATION

22/01929/OUT | Outline Planning Permission (Access Not Reserved) – Creation of industrial estate to include employment floor space for Class E, B2, and B8 uses and associated internal access roads, landscaping, parking, and other associated works | Swatlands Farm Lucks Lane Paddock Wood Tonbridge Kent TN12 6QL.

Cllr C Williams proposed and Cllr M Ridger seconded that standing orders be suspended to permit residents to speak on this matter. Carried unanimous.

The residents expressed disappointment and concern that the points they made in their comments upon the application and when they attended the TWBC Planning Committee meeting did not seem to have been taken into account in the decision to  grant outline permission and furthermore had not be addressed in the . Their primary concerns related to :

  • Highways
  • Surface water drainage
  • Foul drainage
  • Poor maintenance of drainage ditches and culverts
  • Phasing of build with flood mitigation

Cllr C Williams proposed and Cllr T Bisdee seconded that standing orders be reinstated. Carried unanimous.

Members expressed concern that the application had been passed with 37 conditions when the NPPF is clear that conditions should be used minimally when determining planning applications and should be used to enhance developments, mitigate for their effects and improve the developments. They are also supposed to be fair, reasonable and practical. Members felt that many of these conditions covered matters that were fundamental to the viability of the development and that some would be unenforceable once the development commenced.

The ‘three tests’ that are supposed to be met to permit use of conditions had, in the opinion of members,not been met in most of these conditions.

Cllr C Williams proposed and Cllr M Ridger seconded that an official complaint should be submitted to TWBC regarding this use of planning conditions and the failure of the officers report to committee to respond to concerns raised by local residents .Unanimous.

 

 

PE46 MAIDSTONE BOROUGH DESIGN AND SUSTAINABILITY DEVELOPMENT PLAN DOCUMENT REGULATION 18 CONSULTATION

PE47  Kent Highways Forward Work Programme (Years 1 & 2)

The Chairman noted that the improvement to/straightening of the Badsell Road/Maidstone Road Road/Mascalls Court Road junction was not included in the forward plan and suggested that the Highways officers who had previously attended should be invited back to explain this omission and give a progress update as they had promised to do. Members were in agreement with this.

The next meeting will take place at 7.00 pm on Monday 21st of November in the Day Centre, Commercial Road, Paddock Wood.
